Marzano Law - Text and Comments

On the 30th of July 2004 the Italian Parliament has passed into law the decree "Reforming the Energy Sector". All the regulations concerning the upstream sector and intended to ease the current difficulties in the exploration and production of oil and gas have been confirmed. Assomineraria has given a valuable contribution during the lay out of these regulations.
The main points of the so called "Marzano Law" are as follows:
- It has been confirmed the legal status of "concession permit" for all E&P activities.
- The development of hydrocarbons' natural resources is among the main objectives of the energy policy of the country, facilitating their prospecting and use in a environmentally friendly way.
- As far as the offshore activities are concerned, the exclusive competence of the Central Government has been confirmed while the administrative functions for onshore activities will be carried out by the Central Government together with the Regions.
- It has been recognised the right of Regions and Local authorities to ask for or stipulate agreements with the owners of concessions for the introduction of environment-friendly mechanisms.
- It has been introduced a new semplified procedural system to submit research and production permits and concessions.
- It has been updated the regulation on the calculation of royalties for hydrocarbons' production.
- The Central Government has taken the commitment to implement simplified sets of regulations ("Testi Unici") regarding the energy sector.
The new law defines a clearer picture on the different competences and requires a revision of the framework agreement between Central Government and Regions.
